Bidding Instructions - Terms of Sale

The property will be sold as one parcel by private written bids.  All bids must be for the total dollar amount for the parcel, not per acre.

Bid forms may be obtained from James Valley Law, PPLC or Gibbens Law Office of Cando, ND. All bids must be sent by sealed envelope to:  Bracken Bid Sale c/o Gibbens Law Office, PO Box 708, Cando, ND 58324, no later than Tuesday, January 26, 2021 at 9:00 a.m.

All bids will be privately opened by Sellers' attorneys on January 26, 2021. The high bidder will be notified if their bid is accepted or rejected within two (2) days of the bid opening. If the high bid is accepted, Buyer must submit an earnest money down payment for ten percent (10%) of the sales price upon execution of the Purchase Agreement; balance due at closing within sixty (60) days.  Failure to make full payment of the purchase price for the land at closing will constitute a forfeiture of Buyer's earnest money deposit as liquidated damages. ​

Sellers will furnish an up‑to‑date abstract of title, Warranty Deed, and guarantee of marketable title.  All real estate taxes for the calendar year 2020 and prior years will be paid by Sellers; Buyer to assume 2021 real estate taxes.
